This course will explore the ‘new matter’ provisions within the immigration appeals process.
Attendees will gain a solid understanding of what constitutes a ‘new matter’ as we look at how it is defined in statute, case law and Home Office guidance. The session will include practical examples to illustrate the types of issues that may be considered new matters, helping practitioners to identify them with confidence in their own cases.
We’ll examine the procedural aspects of raising new matters during the appeal process, including the appropriate timing and format for doing so. We’ll discuss the strategic considerations practitioners must take into account when seeking the Secretary of State’s consent to argue a new matter, and how to proceed if that consent is refused.
By the end of the session, participants will be better equipped to navigate the legal and procedural challenges involved in identifying and raising new matters in immigration appeals.
