Asylum claims from Palestinians are unique because Palestinians can be “excluded” from protection afforded by the Refugee Convention. Understanding how Article 1D of the Refugee Convention operates is very important for anyone advising on these types of claims.

In this webinar we cover the context of Palestinian refugees in the Middle East, UNRWA protection and assistance, the legal approach to the question of Palestinian refugees and the issue of statelessness. We delve into Article 1D of the Refugee Convention and the key case law interpreting it, and consider how protection claims from Palestinians are dealt with in the UK.

Grace Capel is a barrister at Garden Court Chambers and specialises in asylum, immigration and public law. Grace was part of the legal team instructed in C-349/20 AB and NB v Secretary of State for the Home Department, a referral to the Court of Justice of the European Union concerning the interpretation of Article 1D.Grace has represented many Palestinian appellants in the immigration tribunal, most of whom fled from the UNRWA area of operations in Lebanon.

Jasmine Quiller-Doust is the training manager at Free Movement and solicitor (non-practising). Jasmine has a particular interest in Palestinian refugees in the international law context, and along with Colin Yeo, devised Free Movement’s training course on Palestinian refugees.
