This course explored the ‘new matter’ provisions within the immigration appeals process.

Attendees gained a solid understanding of what constitutes a ‘new matter’ as we looked at how it is defined in statute, case law and Home Office guidance. The session included practical examples to illustrate the types of issues that may be considered new matters, helping practitioners to identify them with confidence in their own cases.

We examined the procedural aspects of raising new matters during the appeal process, including the appropriate timing and format for doing so. We discussed the strategic considerations practitioners must take into account when seeking the Secretary of State’s consent to argue a new matter, and how to proceed if that consent is refused.

By the end of the session, participants were better equipped to navigate the legal and procedural challenges involved in identifying and raising new matters in immigration appeals.

Sanaz Saifolahi. Sanaz is a barrister at Goldsmith Chambers. She has specialised in immigration, asylum and human rights law for over 22 years and is recognised as a leading junior in this area of law.
