New Country Guidance case on situation in Libya

A new Country Guidance case on Libya has been issued. It is a short one and simply states that the previous Country Guidance case should be disregarded for now, pending a more up to date and authoratitive treatment. In the meantime, Libyan cases need to be decided on the evidence presented in the individual case.

The official headnote:

1. The question of whether a person is at art 15(c) risk in Libya should, until further Country Guidance, be determined on the basis of the individual evidence in the case.

2. This decision replaces AT and Others Libya CG [2014] UKUT 318 (IAC) in respect of assessment of the art 15(c) risk.

A mention goes out to Jared Ficklin, who has long argued that AT and Others was dangerously out of date.
