Changes to modern slavery laws passed last year under the Nationality and Borders Act 2022 have been published, ahead of their commencement on 30 January.

Nationality and Borders Act 2022 (Commencement No 4) Regulations 2023 covers identification of potential victims of modern slavery under sections 60-69, which will commence on 30 January.

The regulations and orders published today also cover aspects of unauthorised arrival in the UK for asylum seekers, which will commence on 13 February. The Regulations above bring into force the the imposition of penalties on persons responsible for a goods vehicle which is not adequately secured against unauthorised access and carries people into the UK. The Nationality and Borders Act 2022 (Commencement No 15) Order 2022 also brings into force penalties for failure to secure goods vehicles, and for individuals who have arrived in the UK having concealed themselves on a ship or aircraft. This is rounded off by the Immigration and Asylum Act 1999 (Commencement No 17) Order 2023 in relation to penalties imposed under section 31A of the 1999 Act.

The Carriers’ Liability (Amendment) Regulations 2023 also makes amendments to the carriers’ liability scheme of civil penalties relating to clandestine arrivals.
